Case Study: Establishing Truth in a Wrongful Death
Our infant daughter was killed, our other daughter was severely burned, and our son suffered from smoke inhalation in a house fire, which started in the internal wiring of the house while we slept. Sadly, if there had been a smoke detector, we likely would have all been able to escape the flames and smoke without injury. With Attorney Blatteis’s assistance, we filed a lawsuit against our landlord for never installing a smoke detector in our rental home as he was required to have done by law. After the fire, the landlord claimed he had indeed installed the smoke detector. No one wanted to believe us. Attorney Blatteis listened to our story and created an atmosphere of trust where we were able to speak openly in Spanish, our first language, about this terrible event. He investigated the situation, hired expert fire investigators, and built such a strong case in our favor, that the legal matter was finally settled by the parties without going to trial. It took years of investigation and litigation, but Attorney Blatteis never gave up on our family. Our surviving daughter now has the proper treatment she needs and has received a monetary settlement that is protected in a special needs trust she can use for her particular needs and for her to have significant savings for when she grows up. We now have a comfortable and safe home with functioning smoke detectors, a car to take our kids to school, and a computer for our daughter to do her homework on. Currently, we are looking to send our daughter and son to private school. Attorney Blatteis’s long hours working with us helped us build a new life after such a tragic family event. *Client name withheld for confidentiality purposes.
